Finding: The requested variance for side yard setback ' <br /> is for a single family structure that Is currently under <br /> con,truction in the new plat of Iarsen Park, <br /> Division 1. Building permits were obtained prior to I <br /> construction and the plot plan submitted for the I <br /> building permit application shows a sis foot north side <br /> setback. The house is 98 percent complete at this time <br /> :ind has passed all building inspections to this point. <br /> Construction of another home has started on the lot to <br /> the north which was vacant at the time the subject house <br /> was started. After construction of the house to the <br /> north was begun, it was discovered that the subject <br /> house was not situated properly on the lot and so does <br /> not meet the required side setback, as it is only three <br /> ceet one inch from the north property line on the <br /> northeast corner and `_our feet two inches on the <br /> northwest corner. <br /> b. Conclusion: The unusual circumstances applying to this <br /> property is that the house is 98 percent complete and <br /> Uuilding inspections did not reveal that it was not <br /> sited properl�, so it could have been cortected early in <br /> the construction when Che foundation iras ].aid ouc. <br />
