BOARD OF ADNSTMENT
FINDINGS, CONCLUSIQNS AND ORDER
VABIENCE N0. 1• R9
t3ased upon the written request for a variance from the City's Zoning code by:
Dale Lloyd
17371 NE 67th Court, il
Redmond, WA 98052
hereinafter referred to as "Applicant," for a variance from F..M.C.
19.14.050(B), Side Yards to allow a three foot side yard instead oi
the six foot side yard required by Code.
on the following described property:
Lot 15, Plat of Iarsen Park, Div. 1
commonly known as: 10929 lOth Dr. SE
The Board of Adjustment, following a public hearing on said application held
on February 6, 1989, and further iiaving reviewed all testimony, makes the
following Findings, Conclusions and Order:
FINDINGS AND CONCLUSIONS:
Criterion lll: That there have been exceptional or extraordinary
circumstances or conditions applying to the subject property
or as to the intended use thereof that do not apply
generally to other properties in the same vicinity or zone.
a. Findjng: The requested variance for side yard setback
is for a ingle family structure that is currentl.y under
construction in the new plat of Larsen Park,
Division 1. Building permits were obtained prior to
construction and the plot plau submitted for the
building permit application shows a six foot north side
setback, The house is 98 percent complete at this time
and has passed all building inspections to this point.
Censtruction of another home has started on the lut to
the north which was vacant at the time the subject house
was started. After construction of the house to the
north was begun, it was discovered T.hat the subject
house was not situated properly on the lot and so does
not meet the required side setback, as it is only three
ftet one inch from the north property line on the
northeast corner and =our feet two inches on the
northwest corner.
b. Conclusion: The unusual circumstances applying to this
property is that the house is 98 percent complete and
building inspections did not reveal that it was not
sited properly, so it could have been corrected early in
the construction when the foundation was laid out.
