BOARD OF ADNSTMENT <br /> FINDINGS, CONCLUSIQNS AND ORDER <br /> VABIENCE N0. 1• R9 <br /> t3ased upon the written request for a variance from the City's Zoning code by: <br /> Dale Lloyd <br /> 17371 NE 67th Court, il <br /> Redmond, WA 98052 <br /> hereinafter referred to as "Applicant," for a variance from F..M.C. <br /> 19.14.050(B), Side Yards to allow a three foot side yard instead oi <br /> the six foot side yard required by Code. <br /> on the following described property: <br /> Lot 15, Plat of Iarsen Park, Div. 1 <br /> commonly known as: 10929 lOth Dr. SE <br /> The Board of Adjustment, following a public hearing on said application held <br /> on February 6, 1989, and further iiaving reviewed all testimony, makes the <br /> following Findings, Conclusions and Order: <br /> FINDINGS AND CONCLUSIONS: <br /> Criterion lll: That there have been exceptional or extraordinary <br /> circumstances or conditions applying to the subject property <br /> or as to the intended use thereof that do not apply <br /> generally to other properties in the same vicinity or zone. <br /> a. Findjng: The requested variance for side yard setback <br /> is for a �ingle family structure that is currentl.y under <br /> construction in the new plat of Larsen Park, <br /> Division 1. Building permits were obtained prior to <br /> construction and the plot plau submitted for the <br /> building permit application shows a six foot north side <br /> setback, The house is 98 percent complete at this time <br /> and has passed all building inspections to this point. <br /> Censtruction of another home has started on the lut to <br /> the north which was vacant at the time the subject house <br /> was started. After construction of the house to the <br /> north was begun, it was discovered T.hat the subject <br /> house was not situated properly on the lot and so does <br /> not meet the required side setback, as it is only three <br /> ftet one inch from the north property line on the <br /> northeast corner and =our feet two inches on the <br /> northwest corner. <br /> b. Conclusion: The unusual circumstances applying to this <br /> property is that the house is 98 percent complete and <br /> building inspections did not reveal that it was not <br /> sited properly, so it could have been corrected early in <br /> the construction when the foundation was laid out. <br />
