SE <br /> Everett, WA 98203 <br /> her�einafter referred to as "Applicant," for a variance from E.M.C. <br /> 19. 14.040, Gross Floor Area Aatio, to allow: <br /> a gross floor area ratio of .39 instead of the .30 required by the <br /> Zoning Code <br /> on the following described property: <br /> Lot 22, Mountain View Div. 5 �9�3 _ �U�/-h�� S.E <br /> The Board of pd,justment, followin6 z public hearing on said application held I <br /> on Jun�a 1, 1987, and further having reviewed all testimony, makes the <br /> followi-�g Findings, Conclusio.�s and Order: <br /> FINDIYGS AND CONCLUSIONS: <br /> 1. That there have been exceptional or extraordinary circumstances or <br /> conditions applying to the sub,�ect property or as to the intended use <br /> thereof that do not apply generally to other properties in Lhe same <br /> vicinity or zone. <br /> Finding: The Staff proposal to change the gross floor area r�atio <br /> requirement in the 7.oning Code to a surface coverage requirement is <br /> still unaccomplished, pending the addition of a code writer to the <br /> Planning Department Staff. In developing plans for the purchaser of <br /> the site, the applicant expected that this code chan�2 had <br /> trar.spired, based on conversations he had with Staff inembers last <br /> year regarding the proposed co�:� revision. <br /> Conclusion: The variance as proposed by the applicant appears to be <br /> a reasonable request. <br /> 2. That sueh variance is necessary for the preservation and enjoyment of <br /> a substantial property right of the appellant possessed by the owners <br /> oi othes� properties in the same vicinity or zone. <br /> Find3ng: The Board has granted other requests for variance from the <br /> gross floor area ratio and tl�e City staff will continur to recommend <br /> doing so until the Zoning Code is changed. At its /�pril 6, 198�, <br /> meeting the Board unanimously agreed to grant administrative <br /> authority to the Planning Director on variances up to 10� of the <br /> gross floor area ratio. In the R-1 Zone, this woul.d be up to .33• <br /> Because the applicant requests .39, it was necessary to bring this <br /> request to the Board. <br /> Conclusion: This variance would al!.ow a property right granted to <br /> other propert� owners. <br />� <br />
