-
BOARD OF ADJUSTMENT
FINDINGS CONCWISIONS AND OADER
VARIANCE N0. 15-87
Based upon the written request for a variance from the City's zoning code by:
Ron King/Cronin Custom Homes
8913 - tOth P1. SE
Everett, WA 98203
hereinafter referred to as "Applicant," for a variance from E.M.C.
19. 14.040, Gross Floor Area Aatio, to allow:
a gross floor area ratio of .39 instead of the .30 required by the
Zoning Code
on the following described property:
Lot 22, Mountain View Div. 5 93 _ U/-h S.E
The Board of pd,justment, followin6 z public hearing on said application held I
on Juna 1, 1987, and further having reviewed all testimony, makes the
followi-g Findings, Conclusio.s and Order:
FINDIYGS AND CONCLUSIONS:
1. That there have been exceptional or extraordinary circumstances or
conditions applying to the sub,ect property or as to the intended use
thereof that do not apply generally to other properties in Lhe same
vicinity or zone.
Finding: The Staff proposal to change the gross floor area ratio
requirement in the 7.oning Code to a surface coverage requirement is
still unaccomplished, pending the addition of a code writer to the
Planning Department Staff. In developing plans for the purchaser of
the site, the applicant expected that this code chan2 had
trar.spired, based on conversations he had with Staff inembers last
year regarding the proposed co: revision.
Conclusion: The variance as proposed by the applicant appears to be
a reasonable request.
2. That sueh variance is necessary for the preservation and enjoyment of
a substantial property right of the appellant possessed by the owners
oi othes properties in the same vicinity or zone.
Find3ng: The Board has granted other requests for variance from the
gross floor area ratio and tle City staff will continur to recommend
doing so until the Zoning Code is changed. At its /pril 6, 198,
meeting the Board unanimously agreed to grant administrative
authority to the Planning Director on variances up to 10 of the
gross floor area ratio. In the R-1 Zone, this woul.d be up to .33•
Because the applicant requests .39, it was necessary to bring this
request to the Board.
Conclusion: This variance would al!.ow a property right granted to
other propert owners.
