On March 5, 1986, approximately one year after the PRD was approved <br /> by the Snohomish County Hearing Examiner, the County Planning and <br /> Community Development Department approved landscape changes to <br /> the PRD. In his memorandum, H. George Newman oFthe Snohomish <br /> County Department of Planning and Community Development, stated <br /> "the revised version approved through the minor modification process <br /> deals with building and structure configuration only. All other elements of <br /> exhibit 23 remain as the approved version of the PRD site plan". (exhibit <br /> 10) While there was no specific reference or citation to the re�ulations of <br /> Snohomish County in the County's memo allowing the minor <br /> modification, it appears that the County had a process for minor <br /> modification of buildings and structures within a PRD. <br /> 9. The Appellant submitted that the proposed addition would be small in <br /> scope and wculd be a minor modification. The City responded that <br /> although the Snohomish County regulations may have allowed it, it is no <br /> longer applicable because the subject property �s located within the City <br /> and is under the jurisdiction of the City and its laws and regulations. <br /> (Palacios testimony, Brodhead testimony) <br /> Jurisdiction: The Hearing Examiner of the City of Everett has jurisdictional <br /> authority fo hold a hearing and to issue the decision. That authority is set forth <br /> in EMC 2.23.120. Based on the above findings, the Hearing Examiner enters <br /> the following conclusions: <br /> CONCLUSIONS <br /> 1. The Appellant requeste� approval for an addition to his residence at <br /> 9031 — 11�h Place West, Everett, Washington. This property was part of <br /> a PRD approved by Snohomish County in 1985 which was annexed into <br /> the City of Everett. <br /> 2. EMC 19.32.200 sets forth the requirements in the City of Everett for <br /> minor cnanges in the location, sifing and height of building and structures <br /> in a PRD. The relevan# sections of this ordinance read: <br /> Minor changes in the location, siting, and height of <br /> b�ildings and structures may be authorized by the <br /> Director without additional pubiic hearings if these <br /> changes were required by engineering or other <br /> circumstances not known at the time that the finai <br /> CS <br />� <br />
