WASI TC I <br />96201 <br />The above -referenced addresses are located in an R-1, Single Family <br />Residential zone and business uses are not permitted in that zone. <br />However, if you can provide the City with documentation that the auto <br />repair business was conducted at the above locations prior to the time <br />they were annexed to the City, which was February 25, 1971, and <br />Continuously since that time, the City would consider any documentation <br />submitted in determining whether to grant a Nonconforming Use Permit per <br />Everett Municipal Code (E.M.C.) 19.56 (see enclosure). <br />It is your responsibility to prove to the City that you do have a <br />nonconforming use. In support of your effort to document the <br />nonconforming use, some of the documents the City would consider are: <br />1. 1970 income tax records showing earning from the business; <br />2. Accounting records for the 1970 showing business earnings; <br />3. Copy of P.U.D. records showing commercial rates prior to <br />February 25, 1971; <br />4. Copy of County Assessor's record showing the property <br />assessed as commercial prior to February 25, 1971; <br />5. Notarized affidavits from at least two uninterested <br />neighbors living within 500 feet of your business who will <br />swear that they know you were operating an auto repair <br />business at 10217 and 10225 - 7th Avenue S.E. prior to <br />February 25, 1971. <br />Simply providing the above information does not assure that the City will <br />grant the Nonconforming Use Permit as the City will look at the totality <br />of the information submitted in making its determination. <br />
