r'rerr DATE: 04/18/1990 TO: James and Kathleen Burrows 10217 7th Avenue Everett, WA 98204 NOTICE OF ZONING CODE VIOLATIONS In addition to the aforementiuned Building Code violations, the development of an environmentally sensitive wetland area and the construction of additional garages for the purpose of repairing vehicles violates several sections of the Everett Zoning Code, (Ordinance 1671-89), as follows: "SECTION 37 ENVIRONNENTALLY SENSITIVE AREAS (INTERIM) 37.160 A. Development Activity and Improvements in or Near a Stream Lake or Wetland. 1, renPral, No development activity may take place in nor may any improvements be located in a stream, lake or wetland except as specifically provided in this Subsection or as otherwise permitted or required under the Shoreline Master Program. In addition to the requirements of this Subsection, the applicant shall obtain all necessary State and Federal permits. B. Development - Relocation of Wetlands. 1. Except as otherwise provided in this Section, no development activity may take place in nor may any improvement be located in a wetland. 37.200 Enforcement, Violation, and Penalties B. Any person, firm, corporation, or association or any agent thereof who violates any of the provisions of this Section shall be guilty of a misdemeanor punishable by a fine not to exceed $1,000.00. It shall be a separate offense for each and every day or portion thereof during which any violation of any provisions of this Section is committed. C. Any person, firm, corporation, or association or any agent thereof who violates any of the provisions of this Section shall be liable for all damages to public or private property arising from such violation, including the cost of restoring the affected area to its condition prior to such violation or to such other condition acceptable to the City.
