r'rerr <br />DATE: 04/18/1990 <br />TO: James and Kathleen Burrows <br />10217 7th Avenue <br />Everett, WA 98204 <br />NOTICE OF ZONING CODE VIOLATIONS <br />In addition to the aforementiuned Building Code violations, the <br />development of an environmentally sensitive wetland area and the <br />construction of additional garages for the purpose of repairing <br />vehicles violates several sections of the Everett Zoning Code, <br />(Ordinance 1671-89), as follows: <br />"SECTION 37 ENVIRONNENTALLY SENSITIVE AREAS (INTERIM) <br />37.160 <br />A. Development Activity and Improvements in or Near a Stream <br />Lake or Wetland. <br />1, renPral, No development activity may take place in <br />nor may any improvements be located in a stream, lake <br />or wetland except as specifically provided in this <br />Subsection or as otherwise permitted or required under <br />the Shoreline Master Program. In addition to the <br />requirements of this Subsection, the applicant shall <br />obtain all necessary State and Federal permits. <br />B. Development - Relocation of Wetlands. <br />1. Except as otherwise provided in this Section, no <br />development activity may take place in nor may any <br />improvement be located in a wetland. <br />37.200 Enforcement, Violation, and Penalties <br />B. Any person, firm, corporation, or association or any <br />agent thereof who violates any of the provisions of this <br />Section shall be guilty of a misdemeanor punishable by a <br />fine not to exceed $1,000.00. It shall be a separate <br />offense for each and every day or portion thereof during <br />which any violation of any provisions of this Section is <br />committed. <br />C. Any person, firm, corporation, or association or any <br />agent thereof who violates any of the provisions of this <br />Section shall be liable for all damages to public or private <br />property arising from such violation, including the cost of <br />restoring the affected area to its condition prior to such <br />violation or to such other condition acceptable to the City. <br />
