In addition, building permit applications have been <br /> submitted for construction of the future dwellings. Before any building permits can 6e issued, however, <br /> further information is required in order for the City to verify that the project is in �ompliance with the <br /> Hearing Examiner's decision granting preliminary approval of the project (i.e., "Decision"). <br /> Dased on the clear language in the Decision, the project was reviewed and approved as a subdivision of <br /> land inro more than one lot. Finding of Fact�tl, on page 3 of the Decision states: <br /> TheApplicant requested approval of a preliminaryplatfora clustersubdivision that <br /> would result in two new lots. On these lots ten condominium structures would be <br /> develaped. <br /> However, the final site plan dated approved 08-06-2012 does nct show any new lot lines being created. <br /> The development appears to now consist of a rotal o(nine single-family detached units on one lot <br /> proposed as a condominium. Subdivision of the property is not proposed. Since no new lots are being <br /> created, the developme�t is not mnsistent wi[h the project description, findings, condusions, or <br /> conditions of the Decision. <br /> The Planning Departmeni requests a statemeiit (rom you, in writing, that speci(itally indicates whether <br /> your development will result in additional lots, tracts, or parcels. It addition, please provide a detailed <br /> description of any aspects of the development that deviate from the plans approved as part of the <br /> Decision. For example—changes in the number o( units, unit design, building setbacks, height, etc. We <br /> note the buiiding elevations dated approved 06-28-Z012 do not precisely match the elevations <br /> submitted to the Hearing Examiner in 2008 (Exliibits 11-20). This information will be forwarded to the <br /> Hearin� Examiner for a determination on whether additional proceedings will be required before the <br /> project can move forward in the review process. At a minimum, we believe the decision will need to be <br /> amended to eliminate all references to a division of land or preliminary plat.
