AND WHEREAS, after r.�Per notice was given as required by law, the City of Everett Land Use Hearing Exar.,iner held a public hearing on April 16, 1981, and after considering all evidence elicted during the public hearing; evidence submitted by the applicant; and after a Fersonal inspection of the subject property and surrounding area, if�e Hearing Examiner on 7uly 1, L981, made a recommendation to City Council that the Special Property Use Permit, as applied for by St. Mary Magdalen Parish to ailow construction of a 13,900 square foot addition consisting of five perm�nent classrooms to replace five portable classrooms and the addition of a new s�ience room, library, and ', office be granted subject to conditions; and ' WHEREAS, the Everett City Council concurred with the Hearing Examiner's i recornmendation at its regular meeting on July 22, 1981, 2. NOW, THEREFORE, said permit is granted with the following conditions: 10 feei of addi�:ional right-of-way should be dedicated along Seventh Aver,ue. Civil Engineering plans subrnitted to the Public Works Department must show abutting public rtght-of-way and additional dedication as required by the City Ordinance. A covenant to formation of a Local Improvement District shall be provideC for future improvements to public right-of-way on Seventh Avenue and 88th Street S.E. The design of temporary pedestrian improvements that are required o� 88th Street S.E. and on Seventh Avenue shall be approved by the City Transportation Engineer. On-site detention is required with drainage calculations to he submitted on the City Drainage Submission Form. Drainage systerns from the site rnust be developed to collect and transfer storm water to existing systems by approved methods. 7. A temporary erosion control plan shall be -ubmitted by the Applicant and approved by the Public Works Department prior to the commencement of earth work on the site. All reseeding of exposed earth is required within 30 days of completion of the earth work. !8. Participation in the funding of the South End Sewe^ Interceptor is required. The I approximate cost based on the preliminary in`_ormation provided is $9.86 per student, based on design capacity. Credit will be given for the existing studeni load. The acutal cost shall be computed by 4he Building Department per the � Ordinance in effect at the time and according to the information provided on the approved plans on the date of permitissuance. , 9.
