Ttie City would lil:e to facilitate tlie construction oi new <br />housing and ;o reduce tlie efiects of inflation on the final costs of fiousing to the <br />residcnts of Everett. <br />2. Developer recognizes ar�d acknowledges the need for improvement of <br />Casino Road because of the facts set iorih herein and Exhibit A as incorporated <br />herein. Developer shall fully comply with the reyuirements for obtaining a building <br />permit ior its proposed development as s�t iorth in Exhibit A, as �vell as other City <br />ordinances. <br />3. Upon fuifillment by Developer of the requirements current:y set forth <br />in Exhibit A, and compliance with all other applica5le ordinances and regulations, <br />the City wifl issue a building permit to Developer for construction of its proposed _ <br />development in accordance �vith the plans a�d sp:cifica�ions on iile for that project <br />and approved by the City of Everett Building D�partment. <br />!l. Developer will not b� singled out by City to perform any requirement <br />��ihich does not apply equaliy to other developm4nts p; o�sed or to be proposed <br />alan�, Casino Road which are similarly situated. <br />5. Failure i� comply �vith the terms of this Agreement on the part of <br />Develop�.r shall result in immediate suspension of all �rmits related to the <br />ccnstruction of the subject development; all other remedies of the City induding <br />those under the Uniform Eluilding Code or other ordinances of the City are <br />expressly preserved as additional to any remedies herein. <br />6. Upon execution of tfiis A�reement, and compiiance �vith all other <br />applicable ordinances and regulations, the City will. issue grading and right oi way <br />usc permits to Dcveloper for iis proposed dc��clopment in tfie vicinity of Casino <br />Foad.
