L"xcav^u��i� of this soil could <br />result ia the genera[ion of state dangerous waste. In an effort to mini�- iz� t�: ciiance t6at soil, <br />potentially classified as daz:gerous waste, is handled and transpoRed improperl,v, I am requesting that <br />the City iaclude a condition on aoy building permii for constniction projecu condnct� or the Everett <br />Smelter site (see attached map). Any wnstruction projects tha[ will require the mo•n:men[ or <br />disturbance of soil should contain the following condition: <br />Representative soil samples must be collected and analyzecl for total azsenic content. Only <br />soil that will b� dismrbed should be sampled. 'Pse vumber of samples necessary will depend <br />on the amount of soil that will be disturbed. Soil samples should be collected and analyzed in <br />accordance with standazd environmental laboratory procedures. Results of the analysis must <br />be reputtru to the City of Everett Publir, Works Depaz[ment and the Deparnnent of Ecology, <br />Toxics Cleanuu Program, Northwest Regional O�ce. Any excavated soil shall be handled <br />and disposed of in accordance witl� any applicable laws or reg��lations (eg. soii classified as <br />dangerous waste shall be handled and disposed of in accordar.ce widi Chapter 173-303 WAC, <br />the Dangerous Waste Re;ulations). In addition, adequate precautions must be takeu to insure <br />that any disturbed soil does not pose a potential threat to human health and the environment <br />during or after the construction project. Compliance with this condition does not alter the <br />person's obligation to comply with all other applicable l�ws or regulations. <br />In addition to the above condition, I recommend that a copy e� the Snohomish Health District's Public <br />Healt`�•Advisory be attached to any building permit issued for projects within the smelter site study <br />area.
