MEMORANDUM <br />TO: TIM TYLER <br />FROM: MARIAN BENT <br />DATE: 7ULY 20, 1994 <br />SUBJ: 10021 9TH AVE V�! <br />Yesterday, I received a call from the selling agent of this property. He stated that he <br />had a deal pending on the sale of the property and an "Earnest Money Agreement" ir <br />hand. He faxed me a copy of the agreement. <br />According to the agreement, which was signed on June 30th, the deal is due to close in <br />October. There is a copy of a check, which was faxed, for earnest money dated June <br />29th. <br />From past experience regarding the pending sale of property underg�ing abatement, <br />including this property, I have seen sales fail to close. I recommend that we proceed <br />with our Council date and recommended action by Cou�cil. We can always stop <br />abatement once a permit has been issued to the owner of the property. <br />At the present, we are dealing with Mrs. Aya until such a time as a contract has beer <br />signed and an new owner steps forward. The reason we file a Notice of <br />Noncompliance along with the Notice and Order with the County Auditor is to alert <br />prospective buyers of the property to the ongoing abatement action by the City. <br />Therefore, I have no problem proceeding with the pending Council action. <br />� <br />
