The PORT may require the surety to appcar and qualify itself upon the bond. If at <br /> anytime the PORT detennines, in its sole jud�nent, that the surety is insufficient, <br /> the PORT may require the Contractor to furnish additional surety in form and <br /> � anangement satisZactory to the PORT and in an amount r.ot exceeding diat <br /> � originally required. Payments �vill not be made on the Contract until sufficient <br /> surcYy as required is fumished. <br /> i D. The persou signing the rerformance and payment bonds on behal f of the <br /> Contractor sl�nll be aPpropriately authorized to do so. <br /> 4.3 Extension of Time <br /> If the Ag'eement form is not executed or not submitted to the PORT within the time <br /> � required and, in the PORT's discretion, circums.ances warrant an extension of time, it <br /> } may extend die time for execution of the Agreement form or for fumishing bonds and <br /> insurance certificates. <br /> � 4.4 Failure to Execute Contract <br /> I If the Bidder awar�led the Contract fails to execute the A�'eement fonn and fumish the <br /> required bonds and insurance ceRificates within ten days from delivery of the Notice of <br /> I Award, or declares in writing its intent not to execute the Contract, its Bid Guaranty shall <br /> be forfeited to the PORT and the PORT may issue Notice of Award to the second lowest <br /> responsible Bidder, and in like mam�er until the A�eement form and bonds are executed <br /> I by a responsible Bidder to whom award is made, or further Bids are rejected.
