27. The zoning code requires that the following finding be made in order to approve a rezone: <br /> The proposal is consistent with the applicable provisions of the Everett General <br /> (Comprehensive) Plan. <br /> The proposal bears a substantial relation to the public health, safety, or welfare. <br /> The proposal promotes the best long term interests of the Everett community. <br /> (EMC 19.41.160) <br /> WHEREAS, the City Council concludes: <br /> 1. The proposed land use map amendment does not conform with RCW 36.70.547 in that it <br /> would encourage the siting of incompatible land uses (residential) in proximity to <br /> Snohomish County Airport at Paine Field, a general aviation airport. <br /> 2. The applicant has not demonstrated that the proposed land use map amendment is <br /> consistent with the land use map amendment criteria because he has not demonstrated <br /> compliance with: <br /> "The proposed land use designation must be supported by or consistent with the existing <br /> policies of the various elements of the comprehensive plan." <br /> The proposed land use designations are not consistent with existing land use policies <br /> which call for preservation of industrial land for future economic growth, protection of <br /> industrial lands from encroachment by land uses which would reduce the economic <br /> viability of existing industrial lands, and with the locational criteria for the requested land <br /> use designations. The applicant has not demonstrated that the proposed land use <br /> amendment is consistent with other parts of the comprehensive plan, or with the <br /> Snohomish County comprehensive plan for the general aviation airport at Paine Field. <br /> There is substantial evidence in the record that the proposed land use amendment is <br /> inconsistent with adopted policies of the Everett Comprehensive Plan. Land Use Policy <br /> 1.11.3 requires the applicant to demonstrate that industrial use is not feasible and that <br /> conversion to a non-industrial use would not reduce the economic viability of other <br /> industrial lands. Substantial evidence in the record does indicate that the proposed land <br /> use amendment would impact the viability of existing general aviation operations at <br /> Paine Field and industrial operations at the nearby Boeing aircraft manufacturing facility. <br /> Cost to develop a site for the designated use must also be weighed with other factors like <br /> land use compatibility. The applicant has not demonstrated that the proposed residential <br /> use of the site is compatible with a general aviation airport; <br /> 3. The applicant has not demonstrated that the proposed land use map amendment is <br /> consistent with the land use map amendment criteria because he has not demonstrated <br /> compliance with: <br /> "Have circumstances related to the subject property and the area in which it is located <br /> changed sufficiently since the adoption of the Land Use Element to justify a change to the <br /> land use designation? If so, the circumstances which have changed should be described <br /> in detail to support findings that a different land use designation is appropriate." <br /> • <br /> 8 <br />
