WITNESSETH WHEREAS, the undersigned is (are) the owner(s) of or has (have) a substantial interest in the real property legally described above ("Property"); and WHEREAS, the Grantee/Covenantee, the City of Everett ("City") has a substantial interest in the effective and safe use of lands within its borders, and in the health, safety and welfare of its citizens; and WHEREAS, the Owner(s) have applied for permission to place, construct and maintain a secondary kitchen(s) within a single family dwelling unit or residence; and WHEREAS, before the City will issue any permit or approval for a secondary kitchen to be placed, constructed or maintained within a single family dwelling unit on the Property, this Covenant must be signed, acknowledged and recorded in the records of Snohomish County as a restrictive covenant, restricting the use and enjoyment of the Property by placing conditions on the permission to place, construct or maintain a secondary kitchen; and WHEREAS, this Covenant concerns the Grantor/Covenantor's use, occupation, enjoyment of the Property and benefits the City as Grantee/Covenantee; and WHEREAS, this Covenant is intended to bind successors and assigns and run with the land; NOW, THEREFORE, Owner(s) agree(s) to abide by restrictions on occupation, use, and enjoyment of the Property as follows: 1.0wner(s) agree that the single family residence shall not be used for any purpose which is not in full compliance with the conditions of this Covenant and with all City of Everett zoning and building regulations. 2.Owner(s) agree that the internal connection(s) between all living spaces within the single family dwelling shall remain and meet City of Everett building regulations. 3.Owner(s) agree that the occupants of the single family dwelling shall meet the definition of family as defined in the City of Everett zoning code or, if operated as a — 2 — \ Updated August 2009
