RESOLUTION NO. 6869 <br />A RESOLUTION authorizing recovery of abatement costs <br />pursuant to EMC 1.20.090 at 1215 Everett Avenue, Everett, Washington. <br />WHEREAS, the Everett Municipal Code (the "EMC") Section 1.20.090 authorizes the <br />City to abate code violations and recover the abatement costs; and <br />WHEREAS, on April 8, 2015 an Order of the City of Everett Code Official was issued <br />against the property owner Liquidation Properties Inc. (the "Owner") to secure a damaged and <br />dangerous primary structure at 1215 Everett Avenue (the "Property"), parcel number <br />00439161601601, and abbreviated legal description: <br />Section 19 Township 29 Range 05 Quarter SE - EVERETT PLAT OF BLK 616 D-01 - W 41FT <br />OF E 79FT LOT 16 & W 41 FT OF E 79FT OF S 16FT LOT 17 & S 9.1 FT OF N 12.8FT OF W <br />25FT LOT 17 <br />WHEREAS the Owner failed to secure the structure as required by the Order; <br />WHEREAS, the City provided notice to the Owner explaining that failure to <br />immediately abate the above-described violations would result in the City lawfully securing the <br />structure, and that those costs together may become a lien against the property if the Owner <br />failed to reimburse the City the abatement costs; <br />WHEREAS, the City, through a contractor, conducted the abatement including securing <br />the structure from trespass on April 20, 2015; <br />WHEREAS, on May 28, 2015 the City of Everett Violations Hearing Examiner found <br />that the damaged and previously unsecured structure violated the EMC, and issued an Order <br />against the Owner for the EMC violations on the Property; <br />WHEREAS, the City incurred costs in the amount of $393.12 in its boarding and <br />securing the primary structure and the Hearing Examiner imposed a penalty of $500.00 against <br />the Owner; <br />WHEREAS, the Owner has failed to timely pay the penalty and abatement costs; and <br />WHEREAS, notice of Council's consideration of this Resolution was provided to the <br />Owner; <br />
