15. Because of the placement of fill on the subject property, the wetland on-site has <br /> been altered. This alteration was completed prior to any wetland laws or present <br /> ownership of the subject property. (Findings 1 & 8) <br /> 16. The Applicant will request approval of a wetland and buffer enhancement plan that <br /> will include the revegetation of native plant species to the buffer. This will result in <br /> enhancement to the wetland. (Findings 4 & 12) <br /> 17. The enhanced buffer will not result in more than 50% reduction in the standard <br /> buffer width. (Findings 1 & 13) <br /> 18. The reduced buffer will not be less than the minimum dimension allowed by buffer <br /> width averaging. (Finding 13) <br /> RECOMMENDATION <br /> Based upon the preceding findings of facts and conclusions of law, testimony and <br /> evidence submitted at the public hearing, and upon the impression of the Hearing <br /> Examiner of a site view, it is hereby recommended that the Everett City Council approve <br /> the five year extension and the minor development revision of an Intent to Rezone a 2.9 <br /> acre site north of Casino Road, south of SR 526, and east of Hardeson Road, in the City of <br /> Everett, Washington. As part of the approval, the Everett City Council should approve the <br /> variance to allow the height of the buildings that are to be developed on-site to be <br /> measured from the existing grade on-site, rather than the base elevation. The Everett City <br /> Council should also approve the Applicant's request for a wetland buffer reduction to 37- <br /> 1/2 feet. The buffer to be reduced is from the small riparian wetland located in the <br /> northwest portion of the site near Merrill and Ring Creek. <br /> Approval of these requests should be subject to the following conditions: <br /> 1. The five year extension of the Intent to Rezone should be approved. However, after <br /> the five year period has lapsed, the revision, if it is to happen, shall be to an R-3 <br /> zoning designation, rather than R-3 PRD designation. This revision should occur if <br /> the 33 unit apartment project is not constructed within five years. <br /> 2. The height of the structures shall not exceed 35 feet as measured from the existing <br /> grade of the site. Prior to any construction and the issuance of any Building Permit, <br /> the Applicant shall provide elevation figures for the grade. <br /> 3. The wetland buffer width reduction to allow the buffer width to be reduced from 75 <br /> feet to 37-1/2 feet should be granted with the following conditions: <br /> A. A planting plan for the wetland and buffer must be approved by the Planning <br /> and Community Development Department prior to issuance of Building Permits. <br /> Plantings must consist of native vegetation, with an emphasis on planting <br /> 8 <br />
