f <br /> Section 2: The Resolution of Intent to Rezone authorized by Resolution No. 3592 for the <br /> property legally described below is hereby amended by the provisions of this Resolution: <br /> Tracts 25 and 26, Beverly Homesites, Division 1, according to the Plat thereof <br /> recorded in Volume 10 of Plats, page 74, in Snohomish County Washington; <br /> except the south 35 feet of said Tract 25; and except the following parcel of <br /> land in said Tract 26: Beginning at a point 20 feet north of the southwest <br /> corner of said tract 26; thence south 20 feet; thence east 40 feet; thence <br /> northwesterly 45 feet, more or less, to the point of beginning; also, except <br /> portion condemned by the State of Washington for State Highway SR-526 <br /> under Court Cause No. 93010 of the Superior Court of Snohomish County, <br /> State of Washington; and except that portion conveyed to the City of Everett <br /> by deed recorded under Recording Number 8303280307. <br /> Section 3: A height variance and a wetland buffer width reduction request are hereby <br /> granted pursuant to the conditions set forth herein and in the Hearing Examiner's Decision. <br /> Section 4: The time period for the expiration of Resolution No. 3592 is January 29, 1997. <br /> The expiration date set forth in Section 6 of Resolution No. 3592 is hereby amended, <br /> granting an extension for an additional five (5) years, requiring that all improvements <br /> required in Resolution No. 3592 as amended by this Resolution are to be completed on or <br /> before January 29, 2002, or Resolution No. 3592 as amended herein shall become null and <br /> void. Section 6 of Resolution No. 3592 is hereby amended to provide that the City shall <br /> amend the Zoning Map to R-3 by the City Council adopting an Ordinance which specifically <br /> describes the property being rezoned, and development of the site shall be subject to the <br /> requirements of the basic zoning and all regulations in effect at the time of application for <br /> permits if the required improvements are not completed on or before January 29, 2002. <br /> Section 5: Use of Property Inconsistent with Resolution No. 3592 as Amended - If any use <br /> of the herein described property is inconsistent with the terms of Resolution No. 3592 as <br /> amended, either before, during, or after construction and installation of all improvements <br /> required by Resolution No. 3592 as amended, then Resolution No. 3592 as amended shall <br /> become void and all entitlements to the uses permitted herein shall be forfeited, and any use <br /> inconsistent with the underlying zoning of the property shall be deemed a violation of the <br /> zoning code and be subject to violation, enforcement, and penalty provisions thereof. <br /> Section 6: Resolution - A copy of this Resolution shall be recorded with the Snohomish <br /> County Auditor's Office.
