f <br /> Resolution No. 4337 <br /> A RESOLUTION of the City Council of the City of Everett <br /> approving the Non-Conforming Use Permit to allow the <br /> replacement of an existing 60 bed nursing home with a <br /> two story facility of the same 60 bed capacity along <br /> with additional rehabilitation, office and support <br /> services. Also a building lot coverage variance <br /> allowing 39% lot coverage rather than the Code required <br /> 35% lot coverage is approved. <br /> WHEREAS, application was made on March 26, 1996, Forest View <br /> Transitional Health Care for a Non-Conforming Use Permit and <br /> lot coverage Variance, and <br /> WHEREAS, a public hearing was held before the Hearing <br /> Examiner on July 18, 1996, and <br /> WHEREAS, the Hearing Examiner made findings, conclusions, <br /> and rendered a decision, and <br /> WHEREAS, the City Council held a public meeting on this <br /> matter on October 16, 1996, and <br /> WHEREAS, the City Council determined that an erroneous <br /> procedure or a substantial error in fact or error in law <br /> does not exist. <br /> NOW, THEREFORE, BE IT RESOLVED that the Everett City Council <br /> hereby denies the Bryant appeal and upholds said Hearing <br /> Examiner decision and grants Non-Conforming Use Permit #2-96 <br /> and Variance. <br /> l� <br /> / d-- , (- - : / -c <br /> Councilman Introducing Resolution <br /> Passed and Approved this 16th day of October , 1996. <br /> i AI . �a4�'� i <br /> Council President <br />
