154!!!!b <br /> ‘44 �/E?ETT <br /> RESOLUTION NO. 4316 <br /> A Resolution Denying the Boeing Company' s and Snohomish County <br /> Airport' s SEPA Appeals of Everett' s Thresold Determination of <br /> Nonsignificance for Marc Bhend' s Comprehensive Plan Amendment and <br /> Rezone Request <br /> Whereas, the Boeing Company and Snohomish County Airport filed <br /> appeals of the City' s SEPA determination concerning the <br /> comprehensive plan amendment and rezone request of Marc Bhend for <br /> approximately 40 acres of property located on 36th Avenue W. , <br /> Everett; and <br /> Whereas, the appeals were heard by the City' s Hearing Examiner <br /> who issued a decision dated June 26, 1996, in which he <br /> recommended that the appeals of the City' s issuance of a <br /> determination of non-significance be denied; and <br /> Whereas, the Hearing Examiner issued an order of correction dated <br /> July 12, 1996, and an order approving reconsideration dated July <br /> 24, 1996; and <br /> Whereas, per Chapter 2 .23 EMC, the Hearing Examiner' s decision in <br /> this matter constitutes a recommendation to the City Council; and <br /> Whereas, the City Council reviewed the Hearing Examiner' s record <br /> in this matter, heard statements from the Appellants, the <br /> Applicant and the City, and concurs with the Hearing Examiner' s <br /> recommendation; <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br /> EVERETT that the Hearing Examiner' s recommendation in the Boeing <br /> Company' s and Snohomish County Airport' s appeals of the City' s <br /> issuance of a determination of non-significance for a <br /> comprehensive plan amendment and rezone request of Marc Bhend for <br /> approximately 40 acres of property located on 36th Avenue W. , <br /> Everett is accepted as revised by the Orders dated July 12, 1996, <br /> and July 24, 1996, the Findings and Decision of the Hearing <br /> Examiner in this matter as revised by the orders dated July 12, <br /> 1 <br />
