154!!!!b ‘44 �/E?ETT RESOLUTION NO. 4316 A Resolution Denying the Boeing Company' s and Snohomish County Airport' s SEPA Appeals of Everett' s Thresold Determination of Nonsignificance for Marc Bhend' s Comprehensive Plan Amendment and Rezone Request Whereas, the Boeing Company and Snohomish County Airport filed appeals of the City' s SEPA determination concerning the comprehensive plan amendment and rezone request of Marc Bhend for approximately 40 acres of property located on 36th Avenue W. , Everett; and Whereas, the appeals were heard by the City' s Hearing Examiner who issued a decision dated June 26, 1996, in which he recommended that the appeals of the City' s issuance of a determination of non-significance be denied; and Whereas, the Hearing Examiner issued an order of correction dated July 12, 1996, and an order approving reconsideration dated July 24, 1996; and Whereas, per Chapter 2 .23 EMC, the Hearing Examiner' s decision in this matter constitutes a recommendation to the City Council; and Whereas, the City Council reviewed the Hearing Examiner' s record in this matter, heard statements from the Appellants, the Applicant and the City, and concurs with the Hearing Examiner' s recommendation; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVERETT that the Hearing Examiner' s recommendation in the Boeing Company' s and Snohomish County Airport' s appeals of the City' s issuance of a determination of non-significance for a comprehensive plan amendment and rezone request of Marc Bhend for approximately 40 acres of property located on 36th Avenue W. , Everett is accepted as revised by the Orders dated July 12, 1996, and July 24, 1996, the Findings and Decision of the Hearing Examiner in this matter as revised by the orders dated July 12, 1
