A review has been made of the record of this proceeding and of the
testimony presented. Based on that review, it is apparent that the County
can, in fact, impose regulatory remedies for mandatory collection and
increased penalties for dumping or illegal burning.
Accordingly, Finding #32 is amended to read as follows:
32. The City submitted that dumping of yard debris
on public or private property is illegal in the City as
well as in the County and outdoor burning is not
permitted by the Puget Sound Air Pollution Control
Agency. Burning of household or commercial
garbage is illegal throughout the entire Puget Sound
region including the County. According to the City,
the County can impose additional regulatory
remedies, including mandatory collection and
increased penalties for dumping or illegal burning, to
offset reduction in operating revenue caused by the
removal of the City from the County plan.
