Callahan: <br /> B & R Associates has applied to the City of Everett for building <br /> permits for six 4-plexes ( 24 townhouse units known as Pine <br /> Village) to be constructed at the intersection of 13th and Pine in <br /> Evecett . An EIS Checklist has been submitted, and a DNS has been � <br /> issued by the City. The 15-day public comment period expires on i <br /> +�� January 12, 1988 . Under normal circumstances the City would not <br /> � issue building permits until said date. <br /> 1`' The circumstances of this case , however , are different . ln <br /> '�� January, 1985 this same project was p�oposed by B & R Associates , <br /> and a ].5-day environmental review was conducted by the City. No <br /> 1�� objections to the project wete received, and the Citg authocized � <br /> the issuance of building permits . B & R' s plans unexpectedly <br /> '�� changed, however, and the building permits were never picked up. <br /> In the meantime, the life span of the City's DNS expired, ther?by <br /> '�� requiring B & R Associates to ceinstitute the environmental review <br /> � process. <br /> f� The City recently passed an ord.`�nance which deletes the life-span <br /> o� rule relating to environmental reviews . This new ordinance , <br /> ,� however , cannot be retroactivaly applied to the project in <br /> � question. <br /> �I Because of the unusual circumstances of this case, and the minimal <br /> s eisk that any objections will b= filed during the 15-day rI5 <br /> �0 review period, a compromise has been structured to allow �he <br /> R project to proceed immediately . In consideration for the <br /> � immediate issuance of building permits , B & R Assnciates nereby <br /> - - agrees as follo;as: <br /> 1. The building projects will not proceed beyond the f.oundation <br /> st4ge prior to January 13 , 1986 . The foundati.on will be <br /> promptly removed by B & R Assoc; ates if tlie buiiding permits <br />
