, � <br /> MI'rIGATION AGREEME��T �i <br /> THIS AGREEM�NT is made and entered into this 8 day of <br /> �1i�...3u k� � and between EVER�TT SCI-IOOL DISTRICT <br /> NO. 2 ("District") and Engineers Investment Company (E.I.C.), a Washington <br /> partnership and i�s successors or assigns. <br /> RECITALS <br /> A. Engineers Investment Company has applied for Uuilding permits for <br /> construction of 42 multi family dwelling units known as Lake Park Apartments <br /> Addition (the "Project") City of Everett Filing No. SEPA 66-94, located east of 16th <br /> Avenue S. E., north of 112th Street S. E., Everett, Washington 98208, and more <br /> particularly described a.s follows: <br /> Legal Description Attnched as Exhibit A <br /> B. The State Environmental Policy Act ("SEPA") provides processes and <br /> procedures whereby major actions by state and local agencies, including, but iiot <br /> Iimited to, the approvai of building permits, may be reviewed ;o determine the <br /> nature and extent of tl�eir impact on the environment. Impacts on public services, <br /> including schools, are environmen;al impacts for purposes of SEPA. SEPA rec�uires <br /> the mitigation of adverse environmental impacts. <br /> C The Project will be located in an area where school children residing <br /> therein will be served by dte District <br /> D. The District has identified the impacts on the District that will Ue a direct <br /> result of the construction of the Project. <br /> E. Tlte identified impacts include t11e projected addition of 13.73 students to <br /> the District, of which 11.17 will be unhoused. <br /> F. The District projects that the elementary and middle schools serving the <br /> Project will be at capacity when the students from the Project enter school. As a <br /> result, the District •.vill have to provide space in portable classrooms and other school <br /> facilities in order to house and otherwise accornmodate these students. <br /> G: Developer and the District have r.eviewed the mitigation measures <br /> reasonably necessary to mitigate the impacts directly resulting from tlte Project and <br /> have concluded that tile provisions set forth below in tltis Agreement constitute <br /> complete and appropriate prov�;ions for full mitigaticn by Developer of lhe identified <br /> impacts from the Project on khe District. <br /> H. Neither the impacts identified nor the mitigation measures offered herein <br /> affect, reduce or enlarge any olhe: obligation L.I.C. or the Project has to comply with <br /> required land use approvals. <br /> � <br />
