Accordi! g to <br />Snohomish County Assessor's records and building permit history the subject building <br />was constructed prior to December 1, 1956 as a use other than a single-family <br />residence. <br />The building app�ars to have housed a restaurant in the lower unit prior to conversion to <br />residential living space. Based upon building permit histary the units were established in <br />November 1955. By converling the lower portion of the building into a separate living <br />unit the building has moved more to conformance with current code requirements, in <br />particular with regards to parking, than if it had remained a restaurant. No commercial <br />activity is permitted on site. <br />The structure also fails to meet the required twenty-foot front setback from the south <br />property line, as well as the five-foot interior side setback from the west property line. It <br />appears a portion of the structure extends into the City right of way. The City of Everett <br />may require the removal of a portion of the structure from the public right-of-way if the <br />City deems it necessary to utilize this area for municipal purposes. <br />Decision: I hereby find that the uses for the above structure are recognized as legal <br />non-conforming and meet the City of Evzrett Zonirg Code in effect at the time of <br />construction. This certification is subject to re�ocation if it is found that the information <br />upon which this decision was based is erroneous.
