<br />"Grantor," and the Mukilieo W��te:• District, Mukilteo, Washington, herein called �

<br />That said Grantor does hereby convey and confirm unto the said Grantee, right-
<br />of-way or easement for water mains witn necessary appurtenances over, through,
<br />across and upon the following described �roperty in Snohomisli County, H'ashington,
<br />more particularly described as folloNs:
<br />That portion of the north 600 feet of Tracts 34 and 35, Beverly Berry
<br />Tracts, Division No. 2, as per plat recorded in 4'olume 10 of P'iats,
<br />page 20, records of Snohomish County described as follows: A strip
<br />of land 15 feet in width lying 7.5 feet on each side of the following
<br />described centerline: Cornmencing at the northwest corner of said
<br />Tract 34; thence N89°54'40"E a distance of 198.21 feet; thence
<br />SO°23'36"E a distance of 392.24 feet; thence S89°36'24"W a distance
<br />of 25.00 feet to the True Point of Beginniny; thence continuing
<br />S89°36'24"W a distance of 110.00 feet to the terminus of said strip
<br />of land. ,� /

<br />And also granting to the Gran�ee and to those actin9 ur.der said Grantee the
<br />use of such additional area immediately adjacent to said easement as shall be
<br />required for the construction and maintenance of the water main and appurtenances
<br />in the above described easement such additional area to be held to a minimum and
<br />returned to its original state hy the Grantee or its agents.
<br />That said Grantee shall have the right withcut prior +nstitution of any suit
<br />or proceeding at law, at times as may be necessary, to enter upon said property
<br />for the purpose of constructing, repairing, or altering; without incurring any
<br />legal obligation or liability therefore; provided that such constructing, repairing,
<br />altering, or reconstructing of sald water main shall be accomplished in such a
<br />manner that the private improvements existing in this right-of-way shall not be
<br />disi;urbed or destroyed, or in the event ihey are disturbeu or destroyed, they will
<br />be replaced in as good a conditio�r as they were imnediately before the property
<br />was�entered upon by the Grantee.,==-�- �/,�,� �,,��„��,��`
<br />The Grantor shall retain the right to use the surface of said easement, so
<br />long as said use does not interfere with the installation and maintenance of the
<br />water main and so long as no permanent buildings or structures 3re erected on said
<br />easement.
<br />This easement stiall be a covenant running with the land �.nd shall be binding
<br />on the successcrs, heirs, and assigns of both parties hereon.
