NOTICE OF FINAL <br />MITIGATED DETERMINATION OF NON-SIGNIFICAR�CE <br />SEPA 06-023 <br />Hester Townhomes <br />9406 18�h Avenue West <br />July 24, 2006 <br />Description of Proposal: The proposed action is for the issuance of Building and Public <br />Works Permits for the construction of eight (8) single-family detached townhouses, sixteen <br />(16) on-site parking spaces, private ar�d common open-space, on-site recreational facilities <br />and landscaping. The site is located at 9406 18�h Avenue West, Everett, Washington. <br />One (1) Category I wetland was identified on the subject site which is located along the <br />east property boundary and continues off-site. This wetland is associated with a stream <br />found off-sitz to the west of Swamp Creek. Under'.he previous City of Everett <br />Environmentally Sensitive Area Regulations (Ef�lC Chapter 37.090) Planning Department <br />Siaff has classified the on-site wetland as a Category I wetland because of its association <br />with the Kasch Park Bog and the associated stream as a Category III stream. Based upon <br />the City's Environmentally Sensitive Regulations (EMC 37.100) Category I wetlands <br />require a 100-fooi buffer and Category III streams require a 25-foot buffer. There are no <br />direct wetland or stream impacts which are proposed as part of this development. The <br />applicant is proposing a fifty (50) percent reduction of the standard 100-foot buffer which is <br />associated with the on-site Category I wetland. The reduced buffer will be enhanced with <br />a diversity of native trees and shrubs as required mitigation in accordance with Section 37 <br />of the City's ESA Ordinance. The applicant is aiso proposing to dedicate a contiguous lot <br />as an environmentally sensitive tract and no clearing, grading or development will occur in <br />this ESA tract in perpetuity.
