PLANNIAG DIRECTOR DETERMINATION <br />Review Process I # 04-007 <br />ESA #04-007 <br />March 30, 2004 <br />The City of E��erett Planning Director grants approval of a request by Craig <br />Morrison (CMI Home Builders Inc.) to reduce the standard 75-foot wirle wetland <br />buffer to 60 feet on a portion of the property located at 9421 —1 fi�h �,venue W. with <br />the following conditions: <br />The buffer reduction is only approved for ihe southeast corner of the subject site <br />where a garage is being proposed, as shown on the site plan on file wiih the City <br />dated March 26, 2004. A garage currently exists on site, however it is being <br />relocated further north on site to correct a boundary encroachment with the <br />property owner to the south. Any future development will need to be evaluated <br />independently of this approval. This may require additional wetland studies, and <br />compliance with more restrictive code regulations. <br />• The proposed garage construction must meet all other zoning code requirements <br />including height restrictions and setbacks. <br />Subser.tion 37.100.D of the Ci?y of Everett Zoning Code grants the Planning Director the <br />authority to reduce the 75-foot buffer from a Category II wetland by up to 50% when <br />there has been substantial legal alteration of che wetland's �uffer and the remaining <br />buffer :s enhanced sufficiently to improve thie functional value of the buffer. <br />The Planning Director approved the reduced buffer based upon the following: <br />• The buffer has previously been altered prior to 1990. The buffer consists of <br />garage, swimming pool, lawn, and ornamental landscaping. The garage ��as built <br />approximately fifteen years ago, prior to the property being located within the City <br />of Everett city limits. The buffer will not be impacted any more than it already has. <br />The Planning Director's determination may be appealed. Any such appeal must be filed <br />within fourteen calendar days of the date specified below.
