�'"� <br />� <br />BOARD OF ADJi1STMENT <br />FZNDINGS, CONCLUSZONS, AND ORDER <br />VARIANCE NO. 33-88 <br />Based up�n the written request for a variance <br />zoning code by: <br />John Arnestad <br />2701 18th St. <br />Everett, WA 98201 <br />from the City's <br />hereinafter referred to as "Applicant," for a variance from E.M.C. <br />19.16.050 (C), Rear Yards, 19.42.040, Rear Yard Coverage, and <br />19.16.040, Acoessory Building Coveraqe, to allow construction of <br />a carport that would have a one toot rear yard setback instead of <br />the five foot rear yard setback for accessory buildinqs required <br />by code, would cover fifty-two percent of the rear yard area <br />instead of the fifty percent allowed by code, and woul@ have an <br />accessory buildinq covering twenty-four percent of the lot area' <br />instead of the ten percent lot coverage allowed by code for; <br />accessery buildinqs. <br />on the following described proaerty: <br />The W. 40 feet �f Lots 15 and 16, end the S. 4 feet of the <br />W. 40 feet of Lot 14, Block 357, Plat of Ever_ett <br />,commonly known as: <br />� <br />1725 Fulton St. <br />The Board of Adjustment, following <br />application held on November 7, 1988, <br />a11 testimo:iy, makes the following <br />order: <br />FINDINGS ANll COIdCLUSIONS: <br />Criterion No. i: <br />a public hearirig on said <br />and further having reviewed <br />Fi�tdings, Conclusions and <br />That there have been exceptional or extraordinary circumstances <br />or conditions applying to the subject property or as to the in- <br />tended use thereof that do not apply generally to other <br />properties in the same vicinity or zone. <br />a. Findina: The subject property consists of a single <br />family residence on an extremely small lot, 40 feet <br />feet containing 1,840 square feet. The lot is <br />nonconforming for lot size and width since the code <br />requires a minimum of fifty feet of width and 5000 <br />feet of lot area. <br />by 46 <br />square <br />Since this property is nonconforming in so many ways, it <br />is difficult to make a determination as to the yard <br />orientations; however, the zoning code defines front yard <br />as the space exteriding across the width of the lot; <br />therefore, the narth side of the existing house t�hich <br />faces the alley is considered the front yard of this <br />property. <br />The existing structure is nonconforming for front yard <br />setback (north) which is zei-o feet rather than the twenty <br />feet reqLired by code and for sicie yard setback which is <br />approximately four feet on one sidP (west) and one foot <br />on the other (east) instead of the five feet required by <br />code. <br />
