The
firm of Toweill Rice Taylor has provided the City with Hearing Examiner Pro Tern services for land
use and code enforcement hearings for the past year. The Hearing Examiner's Office
recommends that the City continue with this firm's services as Hearing Examiner Pro Tern. EMC
§2.23.040 requires that, following the first year, subsequent terms for the Pro Tern Hearing
Examiner be for a period of four years. The proposed Amendment to the Pro Tern's contract
extends the services for one additional term of four years. The firm's hourly rate remains $120 but
the maximum annual amount will increase from $6,000 to $10,000 to more accurately reflect the
amount of services required.
RECOMMENDATION (Exact action requested of Council):
Authorize the Mayor to sign Amendment No. 1 to Professional Services Contract for Land Use —
Code Enforcement Hearing Examiner Pro Tern for an amount not to exceed $10,000 annually for
four years.
0
J
Administration 11/07
