• <br /> Oi Project: WFP Clearwell No. 2 <br /> Change Order No.3 <br /> Effective January 22, 2009 <br /> Exhibit A- Description of Changed Work <br /> Change Order#3 <br /> Create New"Bid Item#6—entitled, "Change Order#3", in the lump sum amount of$72,985.21, <br /> which shall incorporate Work Change Directives 053 and 054 per the following: <br /> 1. Work Change Directive 053 —Re-open the excavation for the 48-inch Butterfly valve V-15 on <br /> the East side of the existing Finish Water Pump Station No. 1 so the City can make repairs to <br /> the valve operator. Increase Contract amount by$22,985.21. <br /> 2. Work Change Directive 054—If the CONTRACTOR completes his work associated with the <br /> 12-hour shutdown in less than 12 hours, or the 24-hour shutdown in less than 24 hours the <br /> OWNER agrees to pay to the CONTRACTOR as an incentive an amount of$5,000 (five <br /> thousand dollars) per hour for every hour that the shutdown period is reduced. This incentive <br /> shall be limited to a maximum of$25,000 (twenty-five thousand dollars) for a reduction of five <br /> full hours for each shut down. Increase Contract amount by$50,000.00. <br /> If the CONTRACTOR completes his work associated with the 12-hour shutdown in more than <br /> 12 hours,or the 24-hour shut down in more than 24 hours the CONTRACTOR agrees to pay to <br /> the OWNER as a penalty an amount of$5,000 (five thousand dollars)per hour for every hour <br /> that the shutdown period is increased. This penalty shall be limited to a maximum of$25,000 <br /> (twenty-five thousand dollars) for an increase of five full hours for each shut down. <br /> The time shall be calculated based on when the OWNER hands control of the pipeline to the <br /> CONTRACTOR and when the CONTRACTOR hands control of the pipeline back to the <br /> OWNER. <br /> JUSTIFICATION: <br /> 1. Work Change Directive 053 -Excavation was too deep for the City of Everett to do with <br /> equipment they had on site. <br /> 2. Work Change Directive 054—The City perceives a benefit derived from a decreased shutdown <br /> time by reducing the risk to itself and their customers. <br /> CONTRACT TIME: <br /> Contract time will not be changed in this Change Order. <br /> Page 3 of 3 <br />
