\.1 <br /> c. <br /> c. Provide snow and ice control consistent with snow and ice control <br /> provided by the CITY for similar city-owned facilities and shall indemnify the STATE for any <br /> liability arising from its failure to do so. <br /> d. Interpretive, regulatory and/or directional signs <br /> 4.2 The CITY agrees, at its sole cost and expense, to operate and provide for pedestrians <br /> using the Drainage/Pedestrian Bridge, Trails and foot bridges located on state-owned land and/or <br /> state-owned easements, as follows: <br /> a. Hours of public access to the Drainage/Pedestrian Bridge, Trails and foot bridges <br /> shall be consistent with hours of public access for similar city-owned facilities and shall be <br /> posted in a similar manner. The CITY will install any signs required under this subsection <br /> within 12 months of the effective date of the Agreement. <br /> b. The CITY may install interpretive, regulatory and directional signs in addition to <br /> other signs required or allowed by this Agreement, provided that notice is provided to the Area 3 <br /> STATE Maintenance Superintendent or his/her representative by phone at least 24 hours before <br /> installing any such sign. The CITY shall be solely responsible for maintaining signs installed <br /> under this paragraph. <br /> c. The STATE shall not be responsible for providing security or law enforcement <br /> assistance for pedestrians using the Drainage/Pedestrian Bridge, Trails and foot bridges located <br /> on state-owned land and/or state-owned easements. The CITY agrees to provide whatever <br /> security and/or law enforcement assistance that it does for other CITY-owned pedestrian trails. <br /> 4.3 Third Party Damage CITY Responsibility: The CITY shall be responsible for the cost <br /> of repairing damage caused by third parties to the Trails, the gate to the Drainage/Pedestrian <br /> Bridge, and interpretive, regulatory and/or directional signs. <br /> 5. NOTICES AND DEFAULT <br /> 5.1 The operation, safety and maintenance obligations identified in this Agreement shall not <br /> require either PARTY to notify the other,unless otherwise provided under the terms of <br /> this Agreement.
