9 <br /> Bond Register means the books or records maintained by the Registrar containing the <br /> name and mailing address of the owner of each Bond or nominee of such owner and the principal <br /> amount and number of Bonds held by each owner or nominee. <br /> Bond Year means each one-year period that ends on the date selected by the City. The <br /> first and last Bond Years may be short periods. If no day is selected by the City before the <br /> earlier of the final maturity date of the Bonds or the date that is five years after the date of <br /> issuance of the Bonds, Bond Years end on each anniversary of the date of issue and on the final <br /> maturity date of the Bonds. <br /> Call Date means July 1, 2009. <br /> Capital Appreciation Bonds means any Future Parity Bonds all or a portion of the <br /> interest on which is compounded, accumulated and payable only upon redemption or on the <br /> maturity date of such Capital Appreciation Bonds. If so provided in the ordinance authorizing <br /> their issuance, Future Parity Bonds may be deemed to be Capital Appreciation Bonds for only a <br /> portion of their term. On the date on which Future Parity Bonds no longer are Capital <br /> Appreciation Bonds, they shall be deemed outstanding in a principal amount equal to their <br /> Accreted Value. <br /> Chief Financial Officer means the duly qualified, appointed and acting Chief Financial <br /> Officer of the City or any other officer who succeeds to the duties now delegated to that office. <br /> City means the City of Everett, a municipal corporation duly organized and existing <br /> under the laws of the State of Washington. <br /> Code means the federal Internal Revenue Code of 1986, as amended, and applicable <br /> regulations. <br /> Commission means the United States Securities and Exchange Commission. <br /> -6- P:120287 CM1M20287 88O 03/25/09 <br />
