1 <br /> i <br /> ORDINANCE NO. <br /> An Ordinance relating to Domestic Violence-Protection of Animals <br /> Amending Ordinance 1234-86, (EMC 10.22.040) <br /> as provided in Section 6 of this Ordinance. <br /> Whereas, the State of Washington legislature enacted legislation this year related to <br /> protection of animals in domestic violence situations based upon a finding that research shows a <br /> strong correlation between animal abuse, child abuse, and domestic violence; and <br /> Whereas, the State of Washington legislature stated its intent in enacting the 2009 <br /> legislation as "...that perpetrators of domestic violence not be allowed to further terrorize and <br /> manipulate their victims, or the children of their victims, by using threat of violence toward <br /> pets"; and <br /> Whereas, the Everett City Council desires to enact local legislation that makes the City's <br /> regulations pertaining to enforcement of Domestic Violence protection orders consistent with <br /> State law by providing for the protection of animals from perpetrators of domestic violence; and <br /> Whereas,the Everett City Council finds that the provisions of this Ordinance are <br /> necessaryfor the public health, safety and welfare; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Section 4.of Ordinance 1234-86, as amended by Section 3 of Ordinance 1807-91, <br /> Section 3 of Ordinance 2291-98, Section 1 of Ordinance 2466-00, Section 2 of Ordinance 2919- <br /> 06 and Section 1 of Ordinance 3026-07 (EMC 10.22.040),which reads as follows: <br /> Violation of order for protection. <br /> A. Whenever an order is granted under Chapter 7.90, 10.99,26.09,26.10, 26.26, 26.50 or <br /> 74.34 RCW, or there is a valid foreign protection order as defined in RCW 26.52.020, and the <br /> respondent or person to be restrained knows of the order, a violation of any of the following <br /> provisions of the order is a gross misdemeanor, except as provided in subsection B or C of this <br /> section: <br /> 1. The restraint provisions prohibiting acts or threats of violence against, or stalking of, a <br /> protected party, or restraint provisions prohibiting contact with a protected party; <br /> 52 <br />
