3 <br /> INP.iiivinA, , ,, ,- <br /> 41 <br /> ORDINANCE NO. xxxx 09 <br /> AN ORDINANCE regulating the Surface Water System within the eity-City of Everett <br /> and amending Ordinance No.1750-901 as amended:(EMC 14.56)_ <br /> WHEREAS, certain amendments to Ordinance No. 1750-90 as amended by Ordinance 1909-92 <br /> (EMC 14.56) are hereby found to -be necessary to provide compliance with=the City of Everett <br /> National Pollutant Discharge Elimination System (hereafter referred to as NPDES) stormwater <br /> permit, as issued by the Washington State Department of Ecology. <br /> NOW,THEREFORE,THE CITY OF EVERETT DOES ORDAIN: <br /> SECTION 1: Section 4-4 of Ordinance No. 1750-90 (as amended by Section 1 of Ordinance <br /> No. 1750 90 1909-92), which is codified at EMC 14.56.040 and which h-reads as follows: <br /> SECTION 4: DISCHARGE OF POLLUTING MATTER INTO THE SURFACE <br /> WATER SYSTEM PROHIBITED. <br /> It is unlawful for any person to throw, drain, run, or otherwise discharge into the surface <br /> water system, or to cause, permit or suffer to be thrown, drained, run, allow to seep or <br /> otherwise discharge into the surface water system any organic or inorganic matter that <br /> shall cause or tend to cause pollution of such waters, as provided for in this section: <br /> Polluting matter includes, but is not limited to the following: <br /> S:\ttCoMMON\ORDINANCES\ORDINANCE NO, 1909 92AN ORDINANCE REGULATING THE <br /> SURFACE WATER SYSTEM WITHIN THE CITY OF EVERETT AND.AMENDING ORDINANCE No.1750-90 <br /> AS AMENDED BY ORDINANCE 1909-92(EMC 14.56) <br /> Page 1 <br /> 67 <br />
