This was necessitated by two <br /> issues that developed during the recent FERC relicensing process. First,a license article will state that the <br /> City's water supply and quality requirements shall have precedence over power generation. This agreement <br /> describes how disputes are to be settled. Secondly, since the Lake Chaplain lands are being removed from <br /> the FERC Project boundaries,we needed to revise our agreement with the PUD. The City will bear the costs <br /> of revised land management and the PUD will cover the costs of their wildlife biologist staff. <br /> RECOMMENDATION(Exact action requested of Council): <br /> Authorize the Mayor to sign the Third Supplemental Agreement between Public Utility District No. 1 of <br /> Snohomish County and the City of Everett in the form substantially as provided. <br /> 97 <br />
