The PUD filed for a relicense in May 2009. Since there were many unresolved issues among the
stakeholders, the PUD embarked on settlement negotiations. Settlement has been reached with all but one
(i.e. Tulalip Tribes) of the involved parties. This has culminated in a settlement agreement which the parties
will sign supporting 23 license articles. These include the issues of minimum instream flows, recreational
fishing, fish passage at the City's Diversion Dam, water supply, and water quality protection. These articles
taken together secures the reliability and quality of the City's water supply for the next 40 years.
RECOMMENDATION (Exact action requested of Council):
Authorize the Mayor to sign the Settlement Agreement for the Henry M. Jackson Hydroelectric Project in the
form substantially as provided.
37
