Jackson Hydroelectric Project <br /> This SETTLEMENT AGREEMENT FOR THE HENRY M.JACKSON HYDROELECTRIC <br /> PROJECT("Settlement Agreement")is made and entered into pursuant to Federal Energy <br /> Regulatory Commission("FERC")Rule 602, 18 C.F.R. §385.602,by and among: <br /> Public Utility District No. 1 of Snohomish County("District"or"Licensee"); <br /> United States Department of Commerce,National Marine Fisheries Service("NMFS"); <br /> United States Department of Agriculture,Forest Service("USFS"); <br /> United States Department of the Interior,Fish and Wildlife Service("FWS"); <br /> United States Department of the Interior,National Park Service("NPS"); <br /> Washington Department of Fish and Wildlife("WDFW'); <br /> Washington Department of Ecology("WDOE"); <br /> Tulalip Tribes of Washington("Tribe"); <br /> Snohomish County; <br /> City of Everett("Everett"); <br /> City of Sultan("Sultan");and <br /> American Whitewater; _-{Deleted:s <br /> each referred to individually as a"Party"and collectively as"Parties." <br /> RECITALS <br /> WHEREAS, <br /> A. The District and Everett are currently co-licensees for the Jackson Hydroelectric <br /> Project,FERC Project No.2157("Project"). <br /> B. The Project is located on the Sultan River,approximately 24 miles east of Everett, <br /> Washington,in south central Snohomish County in Washington State. <br /> C. The current FERC Project license will expire on May 31,2011. <br /> D. On May 29,2009,the District filed with the Commission a complete and final <br /> application("License Application")for a new FERC license to continue <br /> operating,as sole licensee,the Project("Project License"). <br /> E. The District engaged and collaborated with interested parties through the <br /> integrated licensing process.
