$ - . <br /> the Parties otherwise agree;and provided further,that the Party shall <br /> cotriply with any statutory or regulatory rquireineitts dill stitaf <br /> consultation. <br /> If a Party proposes a reopener or license amendment that another Party <br /> believes would contain a Material Modification of the Settlement <br /> Agreement or would adversely affect resources under its authority,and <br /> objects,then the ADR provisions in section 5 of this Settlement <br /> Agreement shall apply,and the objecting Party must invoke ADR during <br /> the 90-day Notice period or waive its objection. <br /> 4.12 Amendment of Settlement Agreement <br /> In addition to sections 4.2:1 [Mandatory Conditions],4.4.2.2[ESA BiOp],4.5.2.2 <br /> [CWA Section 401],4.6.2 and 4.11,this Settlement Agreement may amended <br /> at any time from the Effective Date throughout its term,by written unanimous <br /> agreement of all Parties still in existence,including any successors. <br /> 4.13 Project Boundary <br /> The Proposed License Articles are expressly designed so as not to result in an <br /> expansion of the Project boundary for the purpose of including the Licensee's <br /> actions under any Proposed License Articles. No Party shall expressly request, <br /> support or advocate that FERC expand the boundary of the Project to include said <br /> actions. <br /> 4.14 Cooperation Among Parties <br /> The Parties shall cooperate in the implementation of this Settlement and the <br /> Project License. <br /> 4.15 Support for Implementation <br /> The Parties shall cooperate in the implementation of this Settlement and the <br /> Project License. Upon the request of the Licensee,the Parties may provide <br /> written communications(or orally,in the event written communication is <br /> impossible to obtain due to reasons outside a Party's control)of support in any <br /> administrative approval process that may be required for implementation of this <br /> Settlement or related articles of the New Project License,subject to available <br /> agency resources and agency authority. The preceding sentence shall not apply to <br /> a federal or state agency exercising administrative approval authority or to a <br /> federal or state agency not participating in the subject proceeding.
