RESOLUTION NO. 4182 <br /> A RESOLUTION for the proposed vacation of a Portion of 96th St. SW, west of <br /> Holly Drive, described as follows: <br /> THAT PORTION OF 96TH STREET SW LYING WITHIN THE SOUTHWEST ONE <br /> QUARTER OF SECTION 13, TOWNSHIP 28 NORTH, RANGE 4 EAST, W.M. <br /> DESCRIBED AS FOLLOWS: <br /> COMMENCING AT THE NORTHWEST CORNER OF THE SOUTH HALF OF SAID <br /> SOUTHWEST ONE QUARTER; THENCE SOUTH 00° 16'40" EAST ALONG THE WEST <br /> LINE OF SAID SUBDIVISION A DISTANCE OF 20.00 FEET; THENCE NORTH 89° <br /> 04'20" EAST A DISTANCE OF 1199.02 FEET (1199 FEET RECORD) TO A POINT ON <br /> THE SOUTH MARGIN OF 96TH STREET SW, SAID POINT BEING THE NORTHWEST <br /> CORNER OF SNOHOMISH COUNTY TAX LOT NO. 1328-043-033-00 AND DESCRIBED <br /> UNDER RECORDING NUMBER 8005160007, SAID POINT ALSO BEING THE TRUE <br /> POINT OF BEGINNING OF THE PARCEL HEREIN DESCRIBED; <br /> THENCE CONTINUING NORTH 89° 04'20" EAST ALONG THE SOUTH MARGIN OF <br /> SAID 96TH STREET SW A DISTANCE OF 862.81 FEET TO THE INTERSECTION OF <br /> SAID SOUTH MARGIN AND THE NORTHWEST MARGIN OF HOLLY DRIVE <br /> (BEVERLY PARK - EDMONDS ROAD); THENCE NORTH 45° 04'38" EAST ALONG <br /> THE NORTHEASTERLY EXTENSION OF THE NORTHWEST MARGIN OF SAID <br /> HOLLY DRIVE, A DISTANCE OF 57.58 FEET TO THE NORTH MARGIN OF SAID <br /> 96TH STREET SW AND THE SOUTHEASTERLY MOST CORNER OF LOT 6 OF <br /> ARCADIA GARDENS AS RECORDED IN VOLUME 11, PAGE 38 RECORDS OF <br /> SNOHOMISH COUNTY; THENCE SOUTH 89° 04'20" WEST ALONG THE SOUTH <br /> LINE OF SAID PLAT OF ARCADIA GARDENS AND THE NORTH MARGIN OF SAID <br /> 96TH STREET SW A DISTANCE OF 903.77 FEET; THENCE SOUTH 00° 55'40" EAST <br /> AT RIGHT ANGLES TO SAID MARGIN A DISTANCE OF 40.00 FEET TO THE TRUE <br /> POINT OF BEGINNING, <br /> SITUATE IN THE COUNTY OF SNOHOMISH, STATE OF WASHINGTON. <br /> and shown on the attached sketch, have petitioned for the vacation of said right-of-way; <br /> WHEREAS, R.C.W. 35.79.010 provided that City Council shall, by resolution, fix a date for <br /> public hearing on said petition; <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF <br /> EVERETT that a public hearing be set for November 15, 1995 at 7:00 P.M., in the City <br /> Council Chambers, City Hall, to consider the proposed vacation of aforesaid right-of-way as <br /> herein described. <br /> (--C- (---- <br /> - L ` Lkflt <br /> t k''', <br /> Councilperson ntroducing Resolution) <br /> PASSED AND APPROVED this 25th day of ctoberk. 1995. <br /> iii i -1, <br /> Council President <br /> kt:vac 1b.doc <br />
