All of the juveniles who will be housed at the Second Chance transitional facility will <br /> remain under the jurisdictional authority of the courts. In other words, these <br /> juveniles will be serving their sentences that have been imposed by the Superior <br /> Court and will be under strict supervisory and custodial control of the DJR. The <br /> Second Chance facility is not a facility for probation or any other type of remedial <br /> custodial treatment other than the serving of the sentence from the felony as <br /> imposed by the courts. <br /> 10. The juveniles at the Second Chance facility will have a structured daily schedule. <br /> Although there will be no bars on windows or doors at the facility, ingress and <br /> egress will be restricted by the custodians of the facility. The juveniles at the facility <br /> will be under constant surveillance and will be required to be in a specific area at a <br /> specific time. <br /> 11. Second Chance will receive referrals from DJR who will retain custodial control over <br /> the juveniles. Screening will occur and, if qualified, the juvenile may be placed at <br /> the facility at the discretion of DJR. The juvenile will not be able to leave until he <br /> has either served the complete sentence or has been transferred to another <br /> correctional facility. No juvenile can leave unescorted. After demonstration of <br /> compliance with the regulations of the Second Chance, the juvenile may go to <br /> school, work, and counseling, but will be under the strict supervision of the Second <br /> Chance officials. <br /> 12. Representatives from DJR and Second Chance testified that although the proposed <br /> facility is an innovative method of custodial treatment for juveniles, it is still a <br /> detentional facility with strict controls imposed by DJR and ultimate jurisdiction <br /> retained by the Superior Courts. The juveniles in the facility are restricted in their <br /> freedom. <br /> 13. Juveniles who are under the custodial control of DJR include those whose parents <br /> impose volunteer placement, juveniles who are placed in the programs through <br /> neglect of their parents and have a court order allowing relief from such neglect, and <br /> those who are placed under the care of DJR because of mental health problems. <br /> None of these types of clients of DJR will be placed at the Second Chance facility. <br /> The Second Chance facility is restricted to juveniles who have had sentences <br /> imposed upon them by Superior Court and who have violated State and local laws. <br /> They are serving a sentence imposed on them by a court. <br />
