Second Chance SPU #5-93 Page -5- 9. All of the juveniles who will be housed at the Second Chance transitional facility will remain under the jurisdictional authority of the courts. In other words, these juveniles will be serving their sentences that have been imposed by the Superior Court and will be under strict supervisory and custodial control of the DJR. The Second Chance facility is not a facility for probation or any other type of remedial custodial treatment other than the serving of the sentence from the felony as imposed by the courts. 10. The juveniles at the Second Chance facility will have a structured daily schedule. Although there will be no bars on windows or doors at the facility, ingress and egress will be restricted by the custodians of the facility. The juveniles at the facility will be under constant surveillance and will be required to be in a specific area at a specific time. 11. Second Chance will receive referrals from DJR who will retain custodial control over the juveniles. Screening will occur and, if qualified, the juvenile may be placed at the facility at the discretion of DJR. The juvenile will not be able to leave until he has either served the complete sentence or has been transferred to another correctional facility. No juvenile can leave unescorted. After demonstration of compliance with the regulations of the Second Chance, the juvenile may go to school, work, and counseling, but will be under the strict supervision of the Second Chance officials. 12. Representatives from DJR and Second Chance testified that although the proposed facility is an innovative method of custodial treatment for juveniles, it is still a detentional facility with strict controls imposed by DJR and ultimate jurisdiction retained by the Superior Courts. The juveniles in the facility are restricted in their freedom. 13. Juveniles who are under the custodial control of DJR include those whose parents impose volunteer placement, juveniles who are placed in the programs through neglect of their parents and have a court order allowing relief from such neglect, and those who are placed under the care of DJR because of mental health problems. None of these types of clients of DJR will be placed at the Second Chance facility. The Second Chance facility is restricted to juveniles who have had sentences imposed upon them by Superior Court and who have violated State and local laws. They are serving a sentence imposed on them by a court.
