All of the exhibits are available for inspection at the Everett Planning Department <br /> located at 2930 Wetmore Avenue, Everett, Washington. <br /> After due consideration of the testimony and evidence presented by the Applicant, <br /> testimony and evidence elicited during the public hearing, and as the result of the <br /> personal inspection of the subject property and surrounding areas by the Everett <br /> Hearing Examiner, the following findings of fact and conclusions constitute the basis of <br /> the decision of the Everett Hearing Examiner. <br /> FINDINGS OF FACTS <br /> GENERAL FINDINGS <br /> 1 . The Applicant requested approval of a Special Property Use Permit and Building <br /> and Public Works Permits for the construction of a 28-bed juvenile care <br /> transition facility on the property located at 40th Street and Smith Avenue, <br /> Everett, Washington. <br /> 2. It is the intent of the Applicant to develop the site with a two-story, 11,960 square <br /> foot structure which will include administrative offices, classrooms, dining and <br /> recreational rooms for a juvenile care transition facility. In addition, the structure <br /> will provide housing and social services to juveniles who are under the <br /> jurisdiction of the State of Washington Division of Juvenile Rehabilitation <br /> Administration (JRA). [This administrative agency was formerly known as <br /> Division of Juvenile Rehabilitation (DJR)]. <br /> 3. Social service facilities, such as those requested by the Applicant, are required <br /> to be reviewed pursuant to the Special Property Use criteria if they are to be <br /> located in a C-2, Heavy Commercial/Light Industrial zone. The subject property <br /> is zoned C-2, Heavy Commercial/Light Industrial. <br /> 4. As part of the administrative review process, the application was subject to State <br /> Environmental Policy Act review (SEPA). As noted on pages #3, #4, and #5 of <br /> the staff report for this hearing (exhibit #1), the project had an extensive <br /> administrative environmental review. This review included hearings before the <br /> Hearing Examiner of the City of Everett and numerous hearings before the <br /> Everett City Council. The final decision by the City Council was the denial of the <br /> SEPA appeal and the approval of a modified Mitigated Determination of Non- <br /> Significance (MDNS) that had been issued for the juvenile care transition facility. <br /> Some of the conditions of the MDNS require the Applicant to restrict placement <br /> and to provide a number of minimum security measures at the facility. <br /> 4 <br />
