t <br /> t <br /> J E�/E!FETT <br /> RESOLUTION NO 4437 <br /> RESOLUTION APPROVING SUBDIVISION ALTERATION #2-95 AND <br /> ADOPTING THE EVERETT HEARING EXAMINERS FINDINGS, <br /> CONCLUSIONS & RECOMMENDATIONS <br /> A Resolution of the City of Everett Approving Subdivision Alteration #2-95 and <br /> Adopting the Hearing Examiner Findings, Conclusions, and Recommendations <br /> for Lots 60 through 70, and 78 through 83, Powder Mill Highlands Division No. 2. <br /> The recommendation set forth amended language pertaining to use of the 80 <br /> foot Native Growth Protection Easement Area on the above mentioned lots. <br /> WHEREAS, David Space, H.G. Stocking, and Mel Erickson did apply for <br /> a Subdivision Alteration of the above mentioned lots to revise the language <br /> pertaining to the use of the 80 foot Native Growth Protection Easement Area; <br /> and <br /> WHEREAS, the City of Everett Land Use Hearing Examiner did hold a <br /> public hearing on March 30, 1995; and <br /> WHEREAS, on April 28,1995, the City of Everett Land Use Hearing <br /> Examiner, did adopt certain Findings, Conclusions, and Recommendations, and <br /> did recommend to the City Council of the City of Everett that the proposed <br /> Subdivision Alteration be approved pursuant to the provisions of RCW <br /> 58.17.215; and <br /> WHEREAS, the City Council of the City of Everett did review the record <br /> and recommendations of the City of Everett Land Use Hearing Examiner on this <br /> matter; and <br /> WHEREAS, the City Council of the City of Everett did provide the <br /> opportunity for property owners, applicants, and the city staff to provide <br /> testimony on the Findings, Conclusions, and Recommendations of the City of <br /> Everett Land Use Hearing Examiners on this matter; and <br /> WHEREAS, the City Council of the City of Everett did find that the record <br /> and recommendations of the City of Everett Land Use Hearing Examiner <br /> contains neither an erroneous procedure nor a substantial error in fact of law; <br /> and <br /> WHEREAS, the City Council of the City of Everett did find that by <br /> approving the amended language pertaining to use of the 80 foot Native Growth <br /> Protection Easement Area clarifies and recognizes the property rights of the <br /> property owners within the above mentioned lots and does provide for a visual <br />
