AFTER RECORDING, RETURN TO: ORIGINA`� <br /> 3002 Wetmore <br /> Everett, WA 98201 I &' ' r <br /> RESOLUTION NO.'5/4:23 <br /> RESOLUTION OF INTENT TO REZONE AND PERFORMANCE AGREEMENT <br /> SILVER LAKE COSTCO STORE <br /> WHEREAS, The Costco Corporation filed an application to rezone property generally located <br /> between Interstate-5 and 19th Avenue S.E., and between 102nd Place S.E. and 106th Street S.E., <br /> from R-1 and C-2 with contract to B-2, for the purpose of constructing a 156,000 square foot <br /> retail/wholesale warehouse with approximately 805 parking stalls; and <br /> WHEREAS, the Everett City Council, after holding a public hearing, decided that the proposed <br /> rezone should be approved pursuant to the provisions of Section 32.130 and 41.160.D.7 of <br /> Ordinance 1671-89 as amended, and shall be subject to the specific conditions set forth in said <br /> Recommendation and Final Environmental Impact Statement dated March 21, 1995 ; and <br /> WHEREAS, the City of Everett finds that by establishing certain standards for the development <br /> of the property to be rezoned,the development plan is compatible with abutting properties as <br /> proposed; and <br /> WHEREAS, the Everett Zoning Code provides a mechanism by which the City and property <br /> owner may enter into a "performance agreement" wherein the proponent of a rezone agrees to <br /> develop property according to the terms of the agreement before the rezone is finalized by the <br /> City. <br /> WHEREAS, the City Council finds: <br /> 1. This Resolution of Intent to Rezone the "Costco Site" to a zoning classification of"B-2" <br /> (Community Business) is consistent with the land use designation applied to the property <br /> by the Everett Comprehensive Plan; and <br /> 2. The conditions applied to the development of the "Costco Site" through the Resolution of <br /> Intent to Rezone will mitigate the impacts associated with the development of the <br /> property,thereby bearing a substantial relationship to the public health, safety and welfare; <br /> and <br /> 3. The Resolution of Intent to Rezone assures that the development of the "Costco Site" will <br /> comply with all applicable City ordinances, regulations and mitigation measures,thereby <br /> promoting the best long terms interests of the Everett community. <br /> 95 061. 50 240 BK303 PG0398 <br />
