CITY OF EVERETT PUBLIC WORKS <br /> SPECIAL PROVISIONS <br /> DOCUMENT 006013-CONTRACT <br /> 1.1 GENERAL <br /> A. THIS CONTRACT is made and entered into this 15 day of FSRVtsa`( , 2017, by and <br /> between the City of Everett, Washington, a municipal corporation existing under the laws of the <br /> State of Washington, hereinafter called the "City," and <br /> 1CAS.SEl- & ASSc7G)PT , ] . a <br /> LA)ASIA I.-A(yTo-1 (t)E;4)JaA'ri�c-) , hereinafter called the"Contractor." <br /> B. In consideration of the sums to be paid to it by the City, Contractor hereby covenants and agrees <br /> to furnish all labor, tools,materials, equipment, and supplies required to build and construct and <br /> to build and construct in a workmanlike manner the Work, improvements, and appurtenances in <br /> accordance with the Specifications and Drawings entitled: "WFP Operations Building Seismic <br /> Retrofit-Rebid(UP3600)", (the"Project"). <br /> 1.2 DEFINITIONS <br /> A. Contract Documents. The following documents ("Contract Documents") are incorporated by <br /> reference and are hereby made a part of this Contract: <br /> 1. Notice to Bidders <br /> 2. Instructions to Bidders <br /> 3. General Conditions <br /> 4. Supplementary Conditions(if any) <br /> 5. Drawings, Standard Plans, and Specifications <br /> 6. Addenda(if any) <br /> 7. Payment and Performance Bond <br /> 8. Contractor's Bid Form <br /> 9. Other documents described as Contract Documents in Section 007213, General <br /> Conditions <br /> 10. All provisions required by law whether set forth and reproduced herein or not. <br /> B. Terms that are capitalized in a Contract Document but not defined in that Contract Document <br /> shall have the meaning defined to them in the other Contract Documents. <br /> C. Contract Time. <br /> 1. Substantial Completion of the Work shall be achieved within 60 working days after the <br /> effective date of the Notice to Proceed. <br /> 2. Physical Completion shall be within 15 working days after the actual date of issuance of <br /> substantial completion. <br /> D. Liquidated Damages. <br /> 1. The parties agree the City will suffer damage and be put to additional expense in the <br /> event that the Contractor does not complete the Work in all respects and have it ready for <br /> use by the Substantial and Physical Completion dates stated above. <br /> 2. Because it is difficult to accurately compute the amount of such costs and damages, the <br /> Contractor hereby covenants and agrees to pay to the City liquidated damages for each <br /> WFP Operations Building Seismic Retrofit-Rebid January 6, 2017 <br /> WO#UP3600 006013 - 1 <br />
