CITY LEASE AGREEMENT This Lease is made this 9th day of December,2016,between the City of Everett,a municipal corporation under the laws of the State of Washington,hereinafter referred to as the "City or Lessor", and SC Everett LLC,hereinafter referred to as "SC Everett or Lessee". WITNESS 1. PREMISES. Except for the southernmost 20 parking stalls along the west fence line, the Lessor does hereby lease to Lessee, and Lessee does hereby lease from Lessor,those certain premises commonly known as W. Marine View Drive Parking Lot, (hereinafter called "Premises"),being located at the northeast corner of West Marine View Drive and 26th Street, Everett, Washington, 98201 and legally described as: Lots 5 thru 16,Block 558, Plat of Everett Div. G, according to the plat thereof recorded in Volume 4 of Plats,page 41,less right of way to the City of Everett per Statutory Warranty Deed recorded under file number 9012030271,records of the Auditor, of the County of Snohomish, State of Washington. 2. TERM. The initial term of this lease shall commence on December 9,2016,and end at midnight December 8, 2017. Any tenancy after the initial term shall be on a month to month basis. Except as otherwise provided in this Agreement,either party may terminate this agreement upon thirty(30) days written notification. 3. RENT. Lessee leases said Premises for said period and agrees to pay a monthly rental in the amount of$2,520.00 on or before the fifteenth day of each month during the term of this lease to: Treasurer City of Everett 2930 Wetmore Everett, WA 98201 or such other place as the Lessor may from time to time designate in writing. If any rent is,at any time, five(5) or more days past due,Lessee will be charged a late charge equal to ten(10) percent of the past due rental amount. All rent payments must be made without deduction or offset. 4. USE. Lessee may use and occupy said Premises for vehicle storage/parking. Only employees of Lessee and Lessee's bank inspectors or contract vendors shall access the Premises. Patrons and customers are prohibited on the Premises. City and its assigns shall retain use of the Premises not in conflict with Lessee's use at all other times. Lessee agrees that its use of the Premises any occupancy thereof Lessee shall comply with the laws,rules and regulations of the governments of the United States, State of Washington, Snohomish County and City of Everett. Lessee agrees to maintain the Premises in good condition and repair throughout the term of the lease. Upon termination of the lease, Lessee shall quit and surrender the Premises in as good a state and condition as reasonable use and wear and tear thereof permit, damage by the elements or other actions not caused by Lessee or its employees,agents,customers or invitees excepted.
