Title VI of the Civil Rights Act of 1964 (and <br /> corresponding sections of the Civil Rights Restoration Act of 1987)prohibits discrimination on the basis of <br /> race, color,national origin, or sex in any federally funded activity. The City's Title VI responsibilities have <br /> existed for several years under Title 23, Code of Federal Regulation(CFR)200 and Title 49, CFR 21, for <br /> jurisdictions receiving federal transportation funds. The Federal Highway Administration(FHWA)has <br /> however,recently required the Washington State Department of Transportation(WSDOT),which <br /> administers the federal transportation funding,to heighten its diligence in documenting local governments' <br /> compliance with Title VI regulations. Accordingly, WSDOT now requires the City to update the attached <br /> Title VI Non-discrimination Plan regularly. This update to the plan makes minor changes to the <br /> organizational assignments in the current plan. The City's failure to adopt,to implement, and to maintain this <br /> plan may serve as grounds for the revocation of at least its federal transportation funding. The next report on <br /> the plan is due December 31,2009, and will cover the Federal Fiscal Year 2009. <br /> RECOMMENDATION: <br /> Adopt the updated City of Everett Title VI Non-discrimination Plan for Federal Fiscal Year 2009. <br /> 13 <br />
