potential impacts on public safety. These potential impacts can be adequately mitigated by <br /> imposing placement guidelines and requiring defined security measures; and <br /> 4. The MDNS (Condition #5) requires a Geotechnical Report addressing slope stability prior to <br /> the issuance of construction permits for the Second Chance facility. Compliance with <br /> requirements of the Geotechnical Report will mitigate impacts on the slopes. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br /> EVERETT THAT: <br /> 1. The decision of the Responsible Official to issue an MDNS for the Second Chance proposal is <br /> affirmed; and the SEPA appeal is hereby denied, with the following exception: <br /> The MDNS is modified to include the following language: <br /> Condition #6: The applicant shall be responsible for providing adequate security measures to <br /> protect the community. These measures shall include, but not be limited to, the following: <br /> a. No violent or sexual offenders shall be placed at the Second Chance facility; <br /> b. electronic monitoring of the facility; <br /> c. security alarms on all exterior doors and windows; <br /> d. exterior security lighting of the facility; <br /> e. headcounts a minimum of every two (2) hours; <br /> f. facility searches for contraband material on at least a weekly basis; <br /> g. minimum of weekly urine analysis; <br /> h. twenty four(24) hour on duty staffing of the facility; <br /> i. escorting residents to all appointments until such time as they are responsible to be in the <br /> community without such supervision. <br /> It shall be the responsibility of the applicant to monitor compliance with these security measures <br /> and provide the Responsible Official with immediate notice of any noncompliance. <br /> 2. The Appellants' request for the withdrawal of the MDNS because of the recent grading action <br /> is hereby denied. <br /> 4 <br />
