• <br /> E!/E/2ETT <br /> RESOLUTION NO. 4008 <br /> A RESOLUTION OF the Everett City Council establishing a no-smoking <br /> policy for City of Everett facilities. <br /> WHEREAS, RCW 70.160, Washington Clean Indoor Act, regulates smoking in public <br /> places. Except for restaurants and a few other types of public facilities, it prohibits <br /> smoking in portions of buildings used by or open to the public. Smoking is allowed in <br /> designated smoking areas; and <br /> WHEREAS, the Washington State Department of Labor & Industries is proposing a <br /> regulation that is to go into effect on October 8, 1994, that regulates smoking within the <br /> indoor work environment. Smoking will be prohibited in common areas including <br /> lunchrooms and restrooms. This regulation is intended to protect workers from <br /> exposure to secondhand smoke. It permits smoking in designated smoking areas that <br /> meet certain criteria. It is the employers responsibility to ensure compliance with this <br /> regulation; and <br /> WHEREAS, since May, 1992, the City has had an administrative policy which forbids <br /> smoking in City vehicles and in City buildings except for established smoking areas; <br /> and <br /> WHEREAS, the City Council has received complaints concerning smoking in City <br /> facilities; and <br /> WHEREAS, the City Council recognizes the impact that smoking has on the health and <br /> well-being of its employees and citizens; <br /> NOW, THEREFORE, BE IT RESOLVED BY THE EVERETT CITY COUNCIL that <br /> smoking is prohibited in all City facilities (i.e., any building or enclosed facility owned, <br /> leased or rented by, and/or operated by the City) including City Park facilities, <br /> restaurants, and City vehicles, except as provided in designated smoking areas and <br /> outside smoking areas in accordance with administrative regulations approved by the <br /> Mayor and BE IT FURTHER RESOLVED BY THE EVERETT CITY COUNCIL that <br />
