c,,,,Ativ— <br /> E1IERETT <br /> RESOLUTION NO. 4007 <br /> A RESOLUTION DENYING THE APPEAL OF DONALD LUNDSTROM <br /> Appeal #3-94 <br /> WHEREAS, Donald Lundstrom filed an appeal of the Planning Director's <br /> decision relating to issuance of a permit to allow an accessory dwelling unit located at <br /> 1821 Baker Avenue (I I.B. #11-94) ; and <br /> WHEREAS, the City of Everett Land Use Hearing Examiner did hold a public <br /> hearing on July 7, 1994; and <br /> WHEREAS, on July 26, 1994 the Hearing Examiner issued a written decision <br /> denying the appeal; and <br /> WHEREAS, on August 29, 1994, the Appellant did file a timely appeal of the <br /> Hearing Examiner's decision, and <br /> WHEREAS, City Council reviewed the record and decision of the Hearing <br /> Examiner in this matter and heard statements from the appellant, applicant and city <br /> staff concerning the appeal; and <br /> WHEREAS, City Council finds that the record and decision of the Hearing <br /> Examiner contains neither an erroneous procedure nor a substantial error in fact or law; <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br /> OF EVERETT that the appeal of Donald Lundstrom is denied and that the decision of <br /> the Hearing Examiner is upheld. <br /> 1--) <br /> Coun person Int ucing esolution <br /> Passed and Approved this 5th day of October, 1994 <br /> Council President <br />
