EASEMF.NT <br /> This easement is granted subject ro aud conditioned upon the following terms, conditions and <br /> covenants: <br /> I. Grantor shall at all times conduct its activities and all other activities conducted on <br /> Grantor's propeny so as not to inrerfere with, obstruct or endanger the usefulness of any <br /> improvements, or othcr facilities, now or hereafter maintained upon the easement. �r in any <br /> way interfere with, obstruct or endanger the City's use of the easement. <br /> 2. Prior to any construction, work or any other activity by Granror within the easement, <br /> notification and plans for the same shall be submitted in writing to the City by Grantor and no <br /> such construction, work or activity by Grantor shall be commenced without City's prior <br /> written agreement that the Grantor's proposed conswction, work or activity will not interfere <br /> with the City's easement granted herein; PRnVIDED, HOWEVER, any changes or revisions <br /> in the plans shall also be subject to City's prior agreement. The City's review of the Grantor's <br /> plans under this easement shall not be deemed to impose any dury or obligation on the City to <br /> determine the adequacy or sufficiency of Grantor's plans and designs nor whether Grantor's <br /> constniction, work or activiry is in conformance with other applicuble plans, codes and <br /> regulations. Funher, ag,reemenc by the Ciry to such construction, work or activity shall not in <br /> any manner be considered as imposing any obligation, dury or liability upon the Ciry as to the <br /> safety or propriety uf such eonstruction, work or activity. <br /> 3. Grantor hrreby authurizes City ro cut, trim and remove any and all brush, trees, <br /> other veeetation or dehris upon the easemen� and the right of access for such purposes. <br /> Grantur also authurizes the City to cu[, trim and remo�e am and all brush, trees, other <br /> vegetatiun and debris on Grantor's properry which. in the Ciry's reasorable judgment, I <br /> cnnstitutes a hazard tn the easement and thr rieht oF acczss f��r such purposes.
