E. and 7th Ave. S. E. <br />Dear Dennls: <br />Thank you for meetinp last Thursday morning, Octobar 24th, at a slte neer 106th St. S. E. and <br />7th Ave. S. E. with myseli end 8111 Way iram The Watershed Company, Brock Baker, the project <br />proponent, and Rich Johnson hom t��e Washington Department oi Flsheries. A sectlon of North <br />Creek near its headwaters flaws across the site end parts of the site are also considered to be <br />wetland. As you know, Mr. Baker wfshes to esteblish the bounderies oi ihe site avaliable to him <br />to proceed with resldential development of the site. Those wauld be the areas not Included within <br />stream and wetlend buflers. <br />Factors whlch would determine ihe extent oi the stream and wetlend buHers to be applied to the <br />slte Include the extent and classificatlon of ihe site's weltands, ihe classiflcation oi North Creek <br />on-site and a determination of Ils use by salmonid flsh, and an Interpretatlon of section 37.150 <br />B of the zoninp code regardinp the setbac�cs requlred tor the particular combinatlon and <br />configuration o1 streams end wetlands on the slte. A wetiand report dated Dec. 24, 1990 was <br />prepared by Raedeke and Aseociates which Identifled and delineated the wetlands on the site. <br />They classilied the wetlands as Categary II which would infer a 50 foot aetback hom ihe wetland <br />bounderies. <br />On April 30, 1991 we co� ��icted elecirofishing In North Creek on the site end Immediately <br />upstream and down:�tream of it, end were unable to capture any fish. A copy of our May 7, 1991 <br />lerier to Brock Beker reporling on our findings Is Included for your �•eference. Though we were <br />unable to find any diiect evldence ihat any salmonid flsh use the on-site section ot North Creek <br />in the present tlme frame, Rich Johnson of the Washington Department of Fisherles expressed <br />to us thet he cor�sida;rs ihe on-site sectlon of stream to have accasional salmanid flsh use based <br />on observatlons of coho spawners upstream of ihe site several years ago and the more recent <br />capture oi coho Juv��nlles several blocks downstream of the site. The stream on-site is <br />intermittem, that Is, It does not flow year around. <br />A determinatlon reaardtng salmonid fish use would normally be important with repard to <br />setbacks because i� the stream on-site were determined to be without salmonid fish use it could <br />be classifled as a category 3 stroam wfih a 25 foot setback whereas if It were determined that <br />1029 Market Slreet, Suite B, Kirkland.
